The State Border Guard Service of Ukraine as subject to implement of state migration policy of Ukraine

Abstract

Under the Ukrainian legislature the solution of targets as regards realization of state migration policy of Ukraine is commissioned to State migration service of Ukraine and other state bodies and law enforcement agencies in particularly to State border service of Ukraine. Activity of the law enforcement agencies in the area of implementation of state migration policy of Ukraine fails to meet present-day requirements: there are not rare cases of action disconformity, impairment of coordination role of authorized bodies as to discontinuation of illegal activity in migration sphere, dissipation of efforts that causes failure to determined targets and brings unreasonable increase of expenses. Under the conditions that the global migration processes intensify as determined by Strategy of state migration policy of Ukraine up to 2025, it is required the effective state regulation in this field which is the prerequisite potential of migration aimed to minimize its negative consequences and to ensure right and freedoms both of migrants and population. Therefore that improvement of migration policy should be one of the priorities of state policy. State regulation enforcement in the migration sphere is the complicated task that needs comprehensive, systematic approach, appropriate financial support, personnel and scientific provision. The study is aimed to analyze the theoretical and practical aspects of activity of State border service of Ukraine as a subject to implement state migration policy as well as to draw up the scientific and theoretical approaches in order to improve its organizational and legal principles. State border service remains to be the organizational key instrument in security strengthening within the border space and adherence to migration regime used in integrated approach. The activity of State migration service of Ukraine as regards the security of migration policy implementation covers two aspects: service aspect and law-enforcement one. Being on the migration stream routes the border units make individuals possible to realize their rights and safe crossing of border and freedom of movement. In addition to that the actual task is to counteract illegal migration. It is considered that one of the measures how to ensure national security is to increase the entry and exit control into and out of Ukraine of foreigners and stateless persons and their adherence to rules of stay on the territory of Ukraine. The extensive and comprehensive spreading of pandemic COVID-19 has its influence upon all spheres of social life and activity as well as migration one. Pandemic of Corona virus has caused changes in the regulation of state border crossing, introduction of mobility limitations in labor and educational spheres etc. In the existing conditions the protection of state border of Ukraine envisages the coordination of many state bodies aiming consequent control over migration flows. The center of such coordination process remains State border service of Ukraine. The aspects of counteraction against illegal migration have been profoundly covered in the article. The conclusion has been drawn that the present conditions of the counteraction against illegal migration by the bodies and divisions authorized to protect state border is getting exterritorial nature and can be realized even abroad. The cooperation of State border service of Ukraine with other law-enforcement authorities as of counteraction in migration sphere has managerial and procedural nature. That cooperation is founded on already existing approaches to direction and coordination activity of central executive bodies and the factors that influence in the border security should be taken into account. By coordinating activity the state border bodies are enabled to realize procedural mandate as of reacting to illegal migration activity and individuals who organize or encourage crossing the border illegally.
