Latest approaches to protection of forcibly displaced persons in the European Union Law

Abstract

The article examines the peculiarities of legal regulation of temporary protection of citizens of Ukraine in the European Union. Four forms of international protection of forcibly displaced persons in EU law are disclosed, in particular: granting refugee status in accordance with the Convention on the Status of Refugees of 1951; granting the status of additional (subsidiary) protection; provision of temporary protection in accordance with the EU Council Directive 2001/55/EC on minimum standards for the provision of temporary protection in cases of mass influx of displaced persons and on measures to maintain balance in the efforts of member states in connection with the reception and consequences of such reception of July 20, 2001; providing humanitarian protection, i.e. providing international protection for humanitarian reasons based on the national legislation of EU member states. It is emphasized that Article 3 of EU Council Directive 2001/55/EC establishes the possibility for EU member states to provide at the national level more favorable conditions for displaced persons, which in practice has led to the existence of different conditions for obtaining temporary protection.
