Prevent of violent crimes committed by marginal groups

Abstract

The article states that social stratification, changes in value orientations, mass desocialization, and illegal migration in the country have created prerequisites for increased marginalization of society. As a result of such global processes, individuals with a low level of legal awareness have emerged, who are characterized by legal uncertainty and an internal refusal to obey the rules of the law, i.e., these individuals are on the verge of lawful behavior. They follow the rules of the law only out of fear of punishment for their illegal actions. The author offers a number of measures for the further development of social relations and the elimination or neutralization of the determinants of crime. The areas of influence of the state and public organizations on the behavior of citizens in compliance with the norms of law are indicated. Persistent legal behavior, as a set of actions, cannot instantly turn into illegal behavior — it happens under the influence of certain factors. Thus, the state can influence the behavior of citizens to prevent unwanted modification of their legal and value orientations. State policy in this direction should include measures to predict, prevent and reduce the impact of conditions that form marginal consciousness, as well as the elimination of marginal attitudes and their consequences. Among the measures to prevent the formation of marginal behavior of the population of Ukraine, there are measures aimed at creating favorable conditions for all members of society and reducing the impact of negative phenomena (adopting the necessary regulatory and legal acts, reducing the stratification of Ukrainian society, raising the standard of living of the lower strata of the population, improving the activities of the main social institutions etc.). In addition, important areas of general social prevention of marginal behavior of the population are ensuring respect for human rights and freedoms, adoption of normative legal acts that meet the requirements of the rule of law, prevention of criminal offenses, improvement of legal culture and awareness of citizens, strengthening of legality, law and order and discipline, etc.
