Organizational and legal framework for electronic document management of restricted information

Abstract

The article examines some aspects of legal regulation of the organization of electronic document management, as well as creation, processing, transmission and storage of electronic documents in the course of activities of public authorities. The author examines the current experience of the State Border Guard Service of Ukraine in the practical implementation of a set of measures to create and ensure the functioning of the departmental electronic document management system. Its introduction has had a positive impact on improving information interaction with public authorities, saving budgetary funds and, in general, on the functioning of the border agency in the national management system. At the same time, in the context of the ongoing armed aggression of the Russian Federation against Ukraine and the urgent need to ensure effective interaction between the security and defense forces and public authorities, the task of implementing organizational and technical solutions that will allow for secure interagency electronic information interaction, taking into account the possibility of protecting restricted information, is becoming increasingly important. However, there are contradictions and gaps in the current Ukrainian legislation on issues that should determine the procedure for creating, processing, storing, and interagency exchange of electronic documents containing proprietary information. This state of affairs does not allow for a complete departure from information exchange in paper form and the introduction of a fully-fledged electronic document management system with electronic documents containing restricted information. The author substantiates the need to develop a separate regulatory legal act establishing the basic organizational and legal framework for electronic document management and use of electronic documents containing restricted information.
