Anti-human trafficking in Ukraine: legal analysis and international cooperation

Abstract

The ongoing military aggression against Ukraine has catalyzed significant challenges, particularly in the realm of human trafficking. As over five million individuals were forced to leave Ukraine during the initial months of the aggression, the risks associated with human trafficking escalated dramatically. Women and children, who constitute the majority of these refugees, are especially vulnerable. This paper presents a comprehensive analysis of the primary forms of forced labor linked to human trafficking within Ukraine, evaluating the effectiveness of current legislation and judicial practices in addressing this issue. Additionally, it explores opportunities for enhancing measures to combat human trafficking through international and interagency cooperation. The study is grounded in an analysis of various sources, including the Constitution of Ukraine, the Criminal Code of Ukraine, the Law of Ukraine "On Combating Human Trafficking," and international legal instruments such as the Palermo Protocol (2000) and the Council of Europe Convention on Action against Trafficking in Human Beings (2005). The findings reveal that the most prevalent forms of forced labor include begging, sexual exploitation, and auxiliary work. Case studies, including specific judicial proceedings, underscore the necessity of aligning Ukrainian legal standards with international norms to effectively combat these forms of exploitation. Furthermore, the study suggests strengthening criminal responsibility for crimes related to human trafficking and recommends the integration of modern information technologies, such as artificial intelligence, to analyze large datasets and identify suspicious activities indicative of trafficking.
