Guarantees of international law order: conceptual international legal principles and features of ensuring in the conditions of migration challenges

Abstract

The article is devoted to the study of conceptual international legal principles and features of ensuring guarantees of international law order in the conditions of intensification of migration processes and modern challenges. Such issues are not widely studied in Ukrainian and foreign publications, therefore they require the generalization of scientific developments, primarily, of international lawyers, economists, political scientists, sociologists and others in a certain direction. In a generalized form, guarantees of international legal order constitute a set of objective and subjective conditions, general and special means, measures aimed at ensuring regulation, protection and defense, restoration in case of violation of the proper regime and state of international legal order, prevention and counteraction to real and potential threats and challenges at the universal, regional and supranational levels. It is noted that there are currently a number of problems in ensuring international law (in particular, the inadequate effectiveness of its guarantees, the activities of such subjects of international law as the UN, the OSCE or individual international judicial or quasi-judicial bodies of the Arab and African regions), their inability to counteract brutal violations of international peace and security, the basic principles of international law, circumvention or violation of existing sanctions regimes against the aggressor state, etc. It is stated that the growth of armed conflicts of an international and non-international nature, economic instability, climate and other environmental, religious-ethnic and other threats, energy and financial and economic crises, economic globalization lead to the intensification of migration processes, internal displacement of the population. Under these circumstances, the need to improve guarantees of international law at equal levels (universal, supranational and regional) in the context of the growth of migration processes is objectified.
