Legal protection against threats from the temporarily occupied territory of Ukraine

Abstract

The article focuses on some aspects of legal regulation of protection of public relations from threats from the temporarily occupied territory of Ukraine, which consist in violation of the procedure for entry into or exit from the temporarily occupied territory. The state border of Ukraine in Crimea, as well as in the East of Ukraine, has remained within the same boundaries as before the occupation. At the same time, the Ukrainian authorities are currently unable to ensure the inviolability of these sections of the State border, and therefore criminal groups, smuggled goods, irregular migrants, etc. may enter the temporarily occupied territory from other States. The author establishes that the provisions of Articles 332-1 of the Criminal Code of Ukraine and 204-2 of the Code of Administrative Offences protect social relations which ensure a balanced state of protection against external and internal threats to the protected interests of a person, society and the State (border security of Ukraine), established and regulated by the legislation on the State border. The principles of bringing persons to justice for violation of the procedure for entering or leaving the temporarily occupied territory under quarantine restrictions and martial law are defined.
