Marginalisation of migration as a factor influencing crime

Abstract

The article examines some aspects of determination of crime by marginalised groups of persons who are recognised as migrants under international legal acts implemented in the legislation of the respective States. It is established that, depending on the time and territorial specifics, the social roots of crime may take on different meanings, but in most cases they include social differentiation and polarisation of society, problems of the crisis of the system of values and behavioural attitudes, political and economic instability. At the same time, the social roots of migration crime include the cultural characteristics of certain ethnic groups, their weak desire to actively interact with the population of the host state, which leads to the marginalisation of these groups and the demonstration of criminal behaviour by their representatives in comparison with other segments of the indigenous population. The marginal behaviour of even a law-abiding migrant with a high level of legal awareness can stimulate a criminogenic situation caused by a combination of a number of negative economic, social, political and other factors (causes), as well as the psychological attitude of the local population to the migrant, which create favourable conditions for committing a criminal offence. The marginalisation of migration can be a source of social conflicts with the local population, cause delinquent behaviour and criminalisation of the migrant’s host society.
