Abstract

In this article, the process of aligning Ukraine’s competition law with European standards in the context of its path to the European community is examined. Special attention is given to the role of the Antimonopoly Committee of Ukraine (AMCU) as an agency with a special status, which plays a key role in balancing the interests of business and governmental authorities. The article conducts an analysis of the AMCU reform, which will facilitate the realization of the set goal. It investigates how the implementation of reforms will enhance the efficiency of the competition authority itself and make the control over monopolies and unfair competition effective. In particular, there are negative trends between the economic effect indicated in the AMCU report as a result of this body’s activities, the size of the fines imposed as administrative penalties by the committee bodies on law violators, and the size of the paid fines and penalties that were transferred by law violators for the period under review. Legal norms have been identified that exist within the framework of the European integration process to strengthen the institutional capacity of the regulator and within which Ukraine must bring its legislation closer to the EU acquis. An analysis of norms related to the expansion of the institutional capacity of the regulator in the field of competition has been carried out. Gaps and shortcomings have been identified in existing regulation that can disrupt the balance of interests of case participants, pose corruption risks, and violate confidentiality of information. The study not only has a legislative direction, but also focuses on the enforcement of competition law, when achieving the effects specified in the work, when the result is a financial result in the regulator’s activities in the field of competition protection.
